PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for all people who have to interpret and apply the CCMA rules and regulations.

The qualifying learner is capable of:
  • Demonstrating an understanding of the purpose and application of the CCMA Rules
  • Demonstrating an understanding of the process for serving and filing documents and various applications filed in terms of the CCMA Rules
  • Demonstrating an understanding of the CCMA Rules pertaining to the conciliation and con-arb, arbitration, pre-dismissal arbitration (188A) processes and certification of award(s) (Section 143) 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING

    Applications refer to condonations, substitution, joinder, variations, rescissions and other preliminary or interlocutory applications.

    1. An explanation is given on the interpretation of proper service and filing of documents, as set out in the CCMA Rules. 

    ASSESSMENT CRITERION 2 
    2. An explanation is given on the calculation of time periods as set out in the CCMA Rules. 

    ASSESSMENT CRITERION 3 
    3. The appropriate process, as set out in the CCMA Rules, is described and applied to real or simulated cases.

    Demonstrate and apply an understanding of the CCMA Rules.

    1. A presentation is given outlining the CCMA Rules that pertain to conciliation, con-arb, arbitration and pre-dismissal arbitration and the ratification of awards. 

    ASSESSMENT CRITERION 2 
    2. The CCMA Rules pertaining to postponements and subpoenas are described and applied to real or simulated cases as examples.

  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA, or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
