PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for managers in all economic sectors. These managers would typically be second level managers such as a heads of department, section heads or divisional heads, and may have more than one team reporting to them.

The qualifying learner is capable of:
  • Identifying and accessing legislation, legal documents and rules
  • Interpreting legislation, legal documents and rules
  • Complying with legislation and rules which regulate business in general and the department/division in particular
  • Identifying areas of non-compliance 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    It is assumed that that people learning towards this Unit Standard are already competent in:
  • Communication at NQF level 4
  • Computer Literacy at NQF level 4
  • The Unit Standards entitled,
  • "Demonstrate basic understanding of the Primary labour legislation that impacts on a business unit"
  • "Demonstrate knowledge and understanding of the Occupational Health and Safety Act 85 of 1991 (OHSA) (as amended) and the responsibilities of management under the Act".

    1. All legislation relevant to the team, department or division is identified and listed for future use.

    2. Legislation relevant to labour, occupational health and safety, the environment, trade constraints, financial framework, legal framework and any other areas specific to the team, department or division can be accessed when required.

    3. Documents will include all relevant internal documents and rules and all external, statutory documents. 

    ASSESSMENT CRITERION 4 
    4. Documents are categorised and filed for later retrieval.

    3. Experts are contracted to develop documents and contracts that fall outside own level of authority or expertise.

    4. Reporting systems are in place according to the requirements.

    5. Compliance issues are communicated to all stakeholders.

    1. Possible areas where non-compliance is possible for the section/ division/department are identified for possible corrective action.

    2. Identified areas are examined to determine if there is compliance or non-compliance.

    3. Appropriate corrective action is listed for areas where non-compliance is identified or where compliance could be closer to the letter of the law.

    4. A report on non-compliance/compliance with applicable legislation is submitted to management for consideration. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    Assessment of this Unit Standard should be contextual and practical.
  • Assessors must be registered as an assessor with the Services ETQA or an ETQA that represents the sector in which the learner is employed and which has a Memorandum of Understanding with the Services SETA ETQA..
  • Moderators must be registered as assessors with the Services ETQA, or with an ETQA that has a Memorandum of Understanding with the Services SETA ETQA.
  • The mechanisms and requirements for moderation should be applied in accordance with the requirements of the relevant ETQA.
  • Assessment should include both formative and summative assessment.
  • Training providers must be accredited by the Services ETQA or with an ETQA that has a Memorandum of Understanding with the Services SETA ETQA.
