PURPOSE OF THE UNIT STANDARD 
The person credited with this Unit Standard will be able to explain the concept, purpose and procedures of service in the civil justice system. They will also be able to list the civil processes of the various courts in South Africa and carry out the service of a court process. The learner will be able to render a return in terms of statutory requirements.

The qualifying learner is capable of:
  • Defining the process of service in the civil justice system.
  • Explaining the different court processes.
  • Explaining and performing manner of service in the civil justice system.
  • Submitting a return of service/non-service.

    It is assumed that learners are competent in:
  • Communication at NQF Level 3 or equivalent.
  • Mathematical Literacy at NQF Level 3 or equivalent.

    The service procedure is described according to legal prescripts.

    The consequences of improper service in the civil justice system are explained in accordance with legal prescripts.

    Court processes are identified in order to determine the manner of service.

    The nature and exigency of court processes are explained according to legal requirements.

    The legal processes of the various courts are listed in terms of jurisdiction.

    Jurisdiction may include but is not limited to the structure of the South African court system and the Sheriff's area of jurisdiction.

    Various manners of service are listed in accordance with rules of the courts.

    The duties related to a specific manner of service are explained in accordance with legal requirements.

    A personal service required in certain situations is carried out according to legal requirements.

    Submit a return of service/non-service.

    A return is defined in accordance with legislation and regulations.

    The requirements of a return are explained in order to comply with the criteria of the courts.

    The consequences of not adhering to time limits are explained in terms of its impact on rendering a return.

    A return is generated in accordance with legislation and regulations.

    The consequences of rendering a false return are explained in terms of its legal implications.
