PURPOSE OF THE UNIT STANDARD 
A person credited with this unit standard is able to:
  • Demonstrate an understanding of the industrial relations legislation,
  • Demonstrate an understanding of human resources legislation,
  • Demonstrate an understanding of negotiations with trade unions.

    This unit standard is intended for persons in both management and organised labour who seek to specialise in employment relations.
    The skills, knowledge and understanding demonstrated within this unit standard are essential for social and economic transformation and upliftment for any individual.

    The scope and context of this unit standard is for persons in both management and organised labour who seek to specialise in employment relations.

    Demonstrate an understanding of labour relations legislation.

    ASSESSMENT CRITERION 1 
    1. The importance and dynamics of labour relationships within human resource management is explained according to labour and human resources principles. 

    ASSESSMENT CRITERION 2 
    2. The stakeholders within labour relation system are identified and their role explained according to labour and human resources principles. 

    ASSESSMENT CRITERION 3 
    3. The rights and responsibilities of employers and employees are identified and explained within current company and legislative context. 

    ASSESSMENT CRITERION 4 
    4. The relationship between company, human resource and labour policies are explained according to labour and human resources principles. 

    ASSESSMENT CRITERION 5 
    5. The components within a labour relationship system are identified and the purposes of each component explained according to labour relationship system.

    6. The nature of law, its purpose in terms of its effects on society is recognised and described according to industrial legislation principles.

    ASSESSMENT CRITERION 1 
    1. Principles and rationale of the basic conditions of employment act, employment equity act, employment contracts act, skills development act, occupational health and safety act and compensation for occupational injuries and diseases act are explained according to the relevant acts. 

    ASSESSMENT CRITERION 2 
    2. Clauses from employment contracts are interpreted according to with employment law.

    3. The provisions of the employment contracts, and significant decisions relating to the negotiation of employment contracts are applied to a given fact situation.

    4. Legislation, policies and procedures regarding persona grievances and breach of contract are explained according to current legislation.

    1. The choice of negotiation or consultation style and process are identified according to the organisation's policies on negotiation and consultation and suits the needs of the particular situation.

    2. Negotiations and consultations are carried out in accordance with the organisation's values, culture, policies and processes. 

    ASSESSMENT CRITERION 3 
    3. Negotiations and consultations are supported by researched information, arguments are clear, propositions are tenable, and the presentation takes account of the obligations and priorities of the organisation. 

    ASSESSMENT CRITERION 4 
    4. Behaviour in negotiations and consultations meet ethical and professional standards based on current good practise, promises and undertakings given are reasonable, realistic and capable of being honoured.

    5. Negotiations and consultations policies and processes are followed and recorded or the parties involved agree the reasons for any deviation.

    6. Complete and accurate records are made of proposals, offers and points of argument, decisions and other proceedings of the negotiations and consultations.
