PURPOSE OF THE UNIT STANDARD 
This Unit Standard focuses on human rights under the South African Constitution. Learners who complete this Unit Standard should know enough about their rights and responsibilities under the Constitution to participate meaningfully in their communities. It could be included as an elective in any workplace qualification. It may be useful to learners in the community, government departments, business, civil society, out of school youth, Safety in Society sector and immigrants applying for citizenship.

The qualifying learner is capable of:
  • Explaining what is meant by human rights.
  • Explaining how the South African Constitution defines the rights and responsibilities of the individual in South Africa.
  • Explaining the role of the Bill of Rights in the South African Constitution.
  • Indicating assistance that is available in a selected area when rights are abused.

    It is assumed that learners are competent in Communication and Mathematical Literacy at NQF Level 1 or equivalent.

    The typical scope of this Unit Standard is:
  • Community refers to the different groups that the learner or people in South Africa interact with. It means the South African community in the broadest sense and includes religious, education, work and local communities, traditional authorities and immigrants.

    SPECIFIC OUTCOME 1 
    Explain what is meant by human rights. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The concept of humanness is explored and an indication is given of what it means to be human. 

    ASSESSMENT CRITERION 2 
    The concept of human rights is explored in relation to the need to protect fundamental human rights. 

    ASSESSMENT CRITERION 3 
    Five basic human rights are named and an indication is given of their corresponding responsibilities. 
    ASSESSMENT CRITERION RANGE 
    Basic human rights include, but are not limited to, life, dignity, socio-economic rights, environmental rights, health rights, consumer rights, the rights of farm workers and political rights.
     

    ASSESSMENT CRITERION 4 
    An indication is given of why human rights need to be protected with reference to the individual, the community and the government. 

    SPECIFIC OUTCOME 2 
    Explain how the South African Constitution defines the rights and responsibilities of the individual in South Africa.

    Reasons why a constitution is necessary are explained with examples.

    ASSESSMENT CRITERION 3 
    The historical background to the development of the South African Constitution is outlined and an indication is given of the relationship of the Constitution to other legislation.

    The fundamental rights protected by the South African Constitution are outlined with reference to the rights and responsibilities of the individual. 

    SPECIFIC OUTCOME 3 
    Explain the role of the Bill of Rights in the South African Constitution. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    The rights protected by the Bill of Rights are identified and an indication is given of how the Bill affects the life and responsibilities of the individual within a community. 

    ASSESSMENT CRITERION 2 
    The implications and impact of the Bill of Rights on a selected community is investigated with reference to the changes since 1994. 

    ASSESSMENT CRITERION 3 
    Ways in which the individual can be actively involved in a local community are discussed with reference to responsibilities under the Bill of Rights. 

    SPECIFIC OUTCOME 4 
    Indicate assistance that is available in a selected area when rights are abused.

    ASSESSMENT CRITERION 1 
    The role of local community structures in the protection of human rights is explained with examples. 
    ASSESSMENT CRITERION RANGE 
    Includes, but is not limited to, Advice Offices, Non-Governmental Organisations, Religious Institutions, Safety Forums, Traditional Systems, Police Forums and Social Services.
     

    ASSESSMENT CRITERION 2 
    The role of the media in the protection of human rights is explained and an indication is given of why freedom of expression is important in a community. 

    ASSESSMENT CRITERION 3 
    Ways of dealing with conflict in situations where human rights are abused are explored for different scenarios. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Assessors for this Unit Standard must be registered as an assessor with the appropriate ETQA or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard must be accredited as a provider through the appropriate ETQA or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
  • Moderation of assessment will be overseen by the appropriate ETQA according to the moderation guidelines and the agreed ETQA procedures.
  • Moderators must be registered as assessors with the relevant ETQA, or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
