PURPOSE OF THE UNIT STANDARD 
This unit standard will enable court based learners to strengthen their administrative skills, improve the processing of family law matters and provide accessible services for people in South Africa.

Learners credited with this unit standard will be able to:
  • Record and examine information in family law documents.
  • Commission family law documents.
  • Use the family law filing system.
  • Plan the family court roll.

    UNIT STANDARD RANGE 
    The filing system and court roll formalities to be covered in this unit standard refer to: the administrative requirements of the divorce courts established in terms of the Administration Amendment Act no 9 of 1929; the administrative requirements of the maintenance courts established in terms of the Maintenance Act no 99 of 1998; the administrative requirements of the domestic violence courts established in terms of the Domestic Violence Act no 116 of 1998; and the administrative requirements of children's courts established in terms of the Child Care Act no 74 of 1983. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Record and examine information in family law documents. 
    OUTCOME RANGE 
    Family law documents must include documents utilised in terms of the Maintenance Act, the Domestic Violence Act, The Child Care Act and the Administration Amendment Act.

    ASSESSMENT CRITERION 1 
    The importance of recording accurate details is defined in the context of legal documents. 

    ASSESSMENT CRITERION 2 
    Information from legal documents is extracted and recorded in a different format. 

    ASSESSMENT CRITERION 3 
    Legal documents and forms are evaluated for accuracy in order to identify omissions in the context of a given case study. 

    SPECIFIC OUTCOME 2 
    Commission family law documents. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Powers and duties of commissioners of oaths are analysed in the context of South African law. 
    ASSESSMENT CRITERION RANGE 
    Powers and duties must include those specified in the Commissioner of Oaths Act 16 of 1963.
     

    ASSESSMENT CRITERION 2 
    Procedures to be followed when commissioning documents are explained in the context of family law. 

    ASSESSMENT CRITERION 3 
    The administration of an oath or affirmation is conducted by way of role play. 

    SPECIFIC OUTCOME 3 
    Use the family law filing system. 
    OUTCOME RANGE 
    The family law filing system must include the maintenance filing system, the children's court filing system, the domestic violence filing system and the divorce court filing system. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The family law filing system is analysed in order to explain its purpose and function. 

    ASSESSMENT CRITERION 2 
    Procedural steps are applied to open new files and allocate file numbers. 

    ASSESSMENT CRITERION 3 
    The ability to add documents and additional information is demonstrated within filing protocols. 

    ASSESSMENT CRITERION 4 
    The importance of informing parties of court dates is analysed within the context of family law matters. 

    ASSESSMENT CRITERION 5 
    Procedures governing family law files are explained once matters have been concluded. 

    SPECIFIC OUTCOME 4 
    Plan the family court roll. 
    OUTCOME RANGE 
    The family court roll must include the maintenance court roll, the children's court roll, the domestic violence court roll and the divorce court roll. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Factual family law matters are analysed to assess the court time likely to be needed in the context of a given case study. 

    ASSESSMENT CRITERION 2 
    Procedures to schedule family law matters are explained in order to facilitate the use of court dates. 

    ASSESSMENT CRITERION 3 
    The ability to prepare family law files and documentation is demonstrated against the requirements of the day's court roll. 

    ASSESSMENT CRITERION 4 
    The ability to set down family law matters for hearings is demonstrated in the context of the capacity of the court. 

    ASSESSMENT CRITERION 5 
    Parties and kinds of witnesses that may attend family law enquiries are identified per area of family law. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this Unit Standard or assessing this Unit Standard must be accredited as a provider with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Moderation of assessment will be conducted by the relevant ETQA at its discretion.
