PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful to people performing duties in the correctional or detention environment.

People credited with this unit standard are able to:
  • Demonstrate knowledge and understanding of the Bill of Rights.
  • Demonstrate knowledge and understanding of which rights are contained in the Bill of Rights and how these rights are described by the Bill of Rights.
  • Demonstrate an understanding of the link between human rights and the Correctional Services Act.
  • Display respect and a positive attitude towards human rights. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already competent in terms of the following outcomes or areas of learning when starting to learn towards this unit standard:

    3. Understanding of supremacy of law resulting in all other laws being subject to it, is demonstrated by explanation and respect shown for the supremacy.

    2. The basic meaning of each of the Human Rights as described in the Bill of Rights are explained to prisoners. 

    ASSESSMENT CRITERION 3 
    3. Understanding is demonstrated that there are specific rights applicable to accused, arrested, and detained persons. 

    SPECIFIC OUTCOME 3 
    Demonstrate an understanding of the link between human rights and the Correctional Services Act.

    1. References to different human rights in the Correctional Services Act are identified and related to the Bill of Rights.

    4. Understanding is demonstrated that prisoners have all the rights contained in the Bill of Rights.

    5. Understanding of the importance of human rights in the correctional environment is demonstrated in accordance to the role that correctional officials play. 

    ASSESSMENT CRITERION 4 
    3. The obligations and requirements set for correctional officials by the Correctional Services Act that relate to Human Rights are identified. 

    ASSESSMENT CRITERION 5 
    2. The human rights contained in the Bill of Rights that are most vulnerable and most relevant in the Correctional environment are identified.

    4. Understanding of the universal nature of human rights are demonstrated in relation to correctional officials having the same rights as they are expected to protect.

    1. Understanding is demonstrated that correctional officials have a legal duty regarding human rights because they represent the State. 

    ASSESSMENT CRITERION 3 
    2. Understanding is demonstrated that human rights does not have to be deserved but belong to people naturally. 

    ASSESSMENT CRITERION 4 
    3. Understanding is demonstrated that human rights does not intend to be a constraint that hamper the execution of duties by correctional officials but rather as a framework within which duties are to be performed. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    1. Anyone assessing a candidate against this unit standard must be registered as an assessor with the relevant ETQA.
    2. Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider through the relevant ETQA by SAQA.
    3. Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines and the agreed ETQA procedures. 

    UNIT STANDARD ESSENTIAL EMBEDDED KNOWLEDGE 
    The following essential embedded knowledge will be assessed through assessment of the specific outcomes in terms of the stipulated assessment criteria:
  • The role of the Constitution of South Africa in the Correctional environment
  • The obligation of the State to abide by the law
  • The Consequences of not abiding by the law

  • Additional references to rights in sections in the Correctional Services Act

    Candidates are unlikely to achieve all the specific outcomes, to the standards described in the assessment criteria, without knowledge of the listed embedded knowledge. This means that for the most part, the possession or lack of the knowledge can be directly inferred from the quality of the candidate`s performance. Where direct assessment of knowledge is required, assessment criteria have been included in the body of the unit standard.

    UNIT STANDARD ASSESSOR CRITERIA 
  • Assessors should keep the following principles in mind when designing and conducting assessments against this unit standard:
  • Focus the assessment activities in terms of the title.
  • Assessment activities should be as close to the real performance as possible and when simulations are used, there should be supporting evidence to show that the person is able to perform in the real situation.
  • Assessment activities should focus on outcomes and should be sufficient to enable evidence to be gathered around all the assessment criteria.
  • The assessment criteria provide the specifications against which assessment judgements should be made. In most cases, knowledge can be inferred from the quality of the performances, but in other cases, knowledge and understanding will have to be tested through questioning techniques. Where this is required, there will be assessment criteria to specify the standard required.
  • All assessment should be conducted in line with the following well documented principles of assessment: appropriateness, fairness, manageability, integration into work or learning, validity, direct, authentic, sufficient, systematic, open and consistent.
