PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for learners who advise individuals at any life stage on Estate planning, give financial advice or engage in wealth management or financial planning. It is applicable to Intermediaries, Financial Planners, Broker Consultants, Bankers, Sales Managers, Key Individuals, Actuaries and Managers in life insurance and financial planning organisations.

The qualifying learner is capable of:
  • Analysing the farm owner's assets.
  • Applying knowledge of tax to a farm owner's estate.
  • Explaining problems that are unique to a farm owner.
  • Advising a farm owner on an estate plan. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    It is assumed that learners are competent in Communication and Mathematical Literacy at NQF Level 4 and are working towards or have a Level 5 Financial Services Qualification or equivalent. In addition, learners should be competent in the Unit Standards, Apply knowledge of estate planning to propose a financial solution for a specific client, ID 242603 and Apply knowledge of estate planning to propose a financial solution for a high net worth client, ID 242592. 

    UNIT STANDARD RANGE 
    The typical scope of this Unit Standard is:
  • Assets include, but are not limited to, limited interest, livestock, plant and machinery, futures, Co-operative loans and shares, land values and water rights.
  • The nature of farming business includes, but is not limited to, yield per hectare, income levels, cash flow, risks associated with the specific type of farm and value of the land.
  • Ownership includes partnerships and legal or business entities.
  • Tax includes income tax, VAT and CGT.

    The nature of farming business is investigated for a specific client.

    The unique assets and liabilities of a farm owner are analysed for a specific farm situation. 

    ASSESSMENT CRITERION 3 
    The nature of ownership of a farm's business entity/entities is represented graphically for a specific farming operation. 

    ASSESSMENT CRITERION 4 
    Knowledge of lifestyle and life stage of an individual are applied to elicit appropriate information from a high net worth client. 

    SPECIFIC OUTCOME 2 
    Apply knowledge of tax to a farm owner's Estate.

    ASSESSMENT CRITERION 1 
    The impact of income tax on a farm owner's estate is explained for a going concern and sale by the executor. 

    ASSESSMENT CRITERION 2 
    The impact of Capital Gains Tax (CGT) on a farm owner's estate is explained for a going concern and sale by the executor. 

    ASSESSMENT CRITERION 3 
    The impact of Value Added Tax (VAT) on a farm owner's estate is explained for a going concern and sale by the executor. 

    ASSESSMENT CRITERION 4 
    The tax consequences of massing are explained with reference to donations tax, transfer duty and CGT. 

    SPECIFIC OUTCOME 3 
    Explain problems that are unique to a farm owner.

    The implications of the Restriction on the Alienation of Land Act are explained to a client. 

    ASSESSMENT CRITERION 2 
    Issues relating to equal inheritance are explained with reference to the marriage regime and an undividable asset. 

    ASSESSMENT CRITERION 3 
    The use of limited interests is evaluated in an estate plan of a farm owner. 

    ASSESSMENT CRITERION 4 
    Problems relating to the income of the surviving spouse are investigated for a specific case. 

    SPECIFIC OUTCOME 4 
    Advise a farm owner on an estate plan.

    ASSESSMENT CRITERION 1 
    An estate plan is proposed for a farm owner where life insurance is part of the solution. 

    ASSESSMENT CRITERION 2 
    An estate plan is proposed to reduce estate duty and ensure equitable inheritance for a farm owner where life cover is not an option.
