PURPOSE OF THE UNIT STANDARD 
The purpose of this unit standard will be useful to learners who are required to implement housing laws and related laws in housing development and management. Learners will be able to interpret and apply the various pieces of legislation and related legislation for housing development and management, the roles, responsibilities and functions of the various stakeholders within housing development fraternity.

The qualifying learner will be capable of:
  • Explaining and discussing the constitutional rights in the context of housing providing adequate housing for all.
  • Analysing, interpreting and applying the relevant legislative frameworks in housing.
  • Communicating key provisions of housing laws and related legislation.
  • Critically examining the housing legislation.in relation to applicability.

    Explain and discuss the constitutional rights in the context of housing providing adequate housing for all. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    The impact of the right to access to housing in terms of the Constitution to other human rights is discussed within context. 

    ASSESSMENT CRITERION 2 
    The concept of "access to housing" in terms of Section 26 of the Constitution is explained in respect of providing housing to all communities as envisaged by the Constitution. 

    SPECIFIC OUTCOME 2 
    Analyse, interpret and apply the relevant legislative frameworks in housing.

    The various pieces of legislation affecting housing are analysed and explained in context.

    The different laws impacting on housing provision are interpreted and explained in a given context.

    Procedures to apply the provisions of legislation are explained and applied in the context of housing development projects.

    Determine roles, functions and responsibilities of role-players in housing provision.

    Roles, functions and responsibilities are analysed in the context of housing development. 

    ASSESSMENT CRITERION 2 
    Different role-players are classified in terms of their functions, roles and responsibilities of the in respect of housing development for strategic partnerships. 
    ASSESSMENT CRITERION RANGE 
    Different role-players may include but is not limited to national, provincial and local government departments and civil society.
     

    ASSESSMENT CRITERION 3 
    Case studies are analysed to identify methods to improve intergovernmental and inter-sectoral communicatio and best practices are benchmarked to enable role-players to fulfil their roles. 

    ASSESSMENT CRITERION 4 
    Strategies based on the roles, functions and responsibilities are developed in consultation with the role-players to ensure that they fulfil their obligations for integrated housing development. 

    SPECIFIC OUTCOME 4 
    Critically examine the housing legislation in relation to applicability. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Problems pertaining to the implementation of housing laws are identified and documented with reference to the management and implementation. 

    ASSESSMENT CRITERION 2 
    Problems relating to the implementation of housing laws and related policies are discussed to submit possible solutions and/or recommendations for amendment for improvement. 

    ASSESSMENT CRITERION 3 
    Various housing related laws impacting on housing development are interpreted and applied in housing development projects. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a learner or moderating the assessment of a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Any institution offering learning that will enable the achievement of this Unit Standard must be accredited as a provider with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Assessment and moderation of assessment will be overseen by the relevant ETQA or by an ETQA that has a Memorandum of Understanding with the relevant ETQA, according to the ETQA's policies and guidelines for assessment and moderation.
  • Moderation must include both internal and external moderation of assessments at exit points of the Qualification, unless ETQA policies specify otherwise. Moderation should also encompass achievement of the competence described both in individual Unit Standards as well as the integrated competence described in the Qualification.
  • Anyone wishing to be assessed against this Unit Standard may apply to be assessed by any assessment agency, assessor or provider institution that is accredited by the relevant ETQA.
