PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful for people working in local authorities and charged with noise control, as appointed Noise Control Officers. They facilitate the generation of policy, develop procedures, apply the by-laws, ensure that issues between complainants and offenders are resolved, and initiate further action where this becomes necessary, including notices and legal proceedings.

More specifically, this unit standard recognises the skill and knowledge required to stay current with national and international provisions for noise management and use this to inform provincial and local authority practice.

People credited with this unit standard are able to:
  • Demonstrate knowledge and understanding of the legislation, regulations, protocols and procedures that apply to noise infringements.
  • Benchmark South African provisions for noise control with international standards.
  • Provide input and guidance to local authorities on legislation and regulations governing noise management. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already competent in terms of the following outcomes or areas of learning when starting to learn towards this unit standard:
  • Competence equivalent to that described in the National Certificate: Environmental Noise, NQF Level 4.

    SPECIFIC OUTCOME 1 
    Demonstrate knowledge and understanding of the legislation, regulations, protocols and procedures that apply to noise infringements. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Pertinent legislation, current and proposed, regulations and by-laws are identified and described with reference to their provisions for dealing with alleged noise infringements. 
    ASSESSMENT CRITERION RANGE 
    Regulations include:
  • Environmental Conservation Act; new regulations promulgated under the Act (regulations for Gauteng; W. Cape; Free State); the national R154; National Environmental Management Act.
     

  • ASSESSMENT CRITERION 2 
    The national, provincial and local provisions for dealing with a noise infringement are described in line with regulations, by-laws and standard operating procedures for own local authority. 

    ASSESSMENT CRITERION 3 
    Procedures for approaching and issuing notices to the general public are described in line with the applicable environmental legislation and Criminal Procedures Act. Process and procedures described are consistent with own role as a peace officer, and appointed noise control officer. 

    ASSESSMENT CRITERION 4 
    Lines of authority at national, provincial and local authority levels are accurately outlined with reference to roles and relative scope of authority. 

    ASSESSMENT CRITERION 5 
    The origin and significance of various policy documents and/or regulations are described in terms of their source, binding authority and status in law. 

    ASSESSMENT CRITERION 6 
    The demarcation of departmental and inter-departmental roles are described and explained with reference to different responsibilities and scope of authority. The importance of this demarcation is explained with reference to minimising the possibilities of overlap and/or dysfunctional conflict.

  • ASSESSMENT CRITERION 7 
    The roles and responsibilities of external agencies, consultants and/or provincial and national authorities are clearly articulated. The importance of this is explained with reference to effective interaction and collaboration.

    Execution of own duties and responsibilities is consistent with agreed protocols and the existing procedural framework.

    Benchmark South African provisions for noise control with international standards.

    ASSESSMENT CRITERION 1 
    The relationship between South African National Standards dealing with noise and international standards is identified in terms of specific provisions and exclusions for the SA context. 

    ASSESSMENT CRITERION 2 
    World Health Organisation guidelines on noise and noise management are identified and matched to South African standards. Differences are explained in terms of contextual issues or noted as input to future strategic and policy discussions. 

    ASSESSMENT CRITERION 3 
    Issues current in International Institute of Noise Control Engineering discussions are identified for relevance to South African concerns. Differences are explained in terms of contextual issues or noted as input to future strategic and policy discussions. 

    ASSESSMENT CRITERION 4 
    Draft codes of practice and/or guidelines for the management of noise in first world and emerging economies are identified in terms of their relevance to the South African context. Differences are explained in terms of contextual issues or noted as input to future strategic and policy discussions.

    Instances in which SA standards are used internationally are identified and reported to local authorities to confirm SA alignment to best practice.

    ASSESSMENT CRITERION 1 
    Own position on noise management is supported by accurate, current and integrated knowledge of international and national positions on noise management. Own position is stated logically and coherently and is useful for decision-making at national, provincial and local levels. 

    ASSESSMENT CRITERION 2 
    The requirements and implications of binding legislation are accurately identified and described in ways that present clear choices and courses of action with respect to compliance, planning and policy. 

    ASSESSMENT CRITERION 3 
    Specific processes for dealing with alleged offenders are accurately articulated together with courses of action for correcting offences, in accordance with current legislation and regulations. 

    ASSESSMENT CRITERION 4 
    The rights of persons before the law are accurately identified, and provide clear guidance for decisions making in dealing with alleged offenders. 

    ASSESSMENT CRITERION 5 
    Advice to Corporate and Legal Departments, and appointed attorneys, clearly demarcates boundaries, rights, duties and responsibilities, and promotes effective and professional approaches to noise management.

    Notes to Assessors:

    Assessors should keep the following general principles in mind when designing and conducting assessments against this unit standard:
  • Focus the assessment activities on gathering evidence in terms of the main outcome expressed in the title to ensure assessment is integrated rather than fragmented. Remember we want to declare the person competent in terms of the title. Where assessment at title level is unmanageable, then focus assessment around each Specific Outcome, or groups of Specific Outcomes.
  • Make sure that evidence is gathered across the entire range, wherever it applies. Assessment activities should be as close to the real performance as possible, and where simulations or role-plays are used, there should be supporting evidence to show the candidate is able to perform in the real situation.
  • Do not focus the assessment activities on each assessment criterion. Rather make sure the assessment activities focus on outcomes and are sufficient to enable evidence to be gathered around all the Assessment Criteria.
  • The Assessment Criteria provide the specifications against which assessment judgements should be made. In most cases, knowledge can be inferred from the quality of the performances, but in other cases, knowledge and understanding will have to be tested through questioning techniques. Where this is required, there will be Assessment Criteria to specify the standard required.
  • The task of the assessor is to gather sufficient evidence, of the prescribed type and quality, as specified in this unit standard, that the candidate can achieve the outcomes again and again and again. This means assessors will have to judge how many repeat performances are required before they believe the performance is reproducible.
  • All assessments should be conducted in line with the following well documented principles of assessment: appropriateness, fairness, manageability, integration into work or learning, validity, direct, authentic, sufficient, systematic, open and consistent.
