PURPOSE OF THE UNIT STANDARD 
This standard provides learners with an opportunity to acquire the competencies relevant to the regulatory framework for traffic law enforcement officials. A large amount of the traffic officer's duties and activities are legally driven. The traffic officer's activities are governed by relevant sections from a number of different Acts. This standard will provide that overarching understanding of legislation that is not directly traffic related but without which a traffic official will not be able conduct law enforcement.

Learners credited with this standard will be able to:
  • Demonstrate an understanding of Chapter 2 of the Constitution.
  • Explain sections of the Criminal Procedure Act that impact on traffic law enforcement.
  • Explain the role and importance of the Law of Evidence within the justice system.
  • Demonstrate an understanding of the relevant aspects of criminal law.
  • Give evidence in a court of law.

    An explanation is given of the importance of the Constitution as the basis for the country's legal framework.

    A description is given of the relationship between the Constitution and other legislation.

    An explanation is given of the application of the limitation clause contained in Chapter 2 of the Constitution.

    ASSESSMENT CRITERION 1 
    Sections of the Criminal Procedure Act referring to search and seizure are explained as they apply to road traffic law enforcement. 
    ASSESSMENT CRITERION RANGE 
    Search and seizure refers to the searching of persons, searching of property and searching of premises.
     

    ASSESSMENT CRITERION 2 
    Sections of the Criminal Procedure Act referring to methods of securing attendance in court are explained as they apply to road traffic law enforcement. 
    ASSESSMENT CRITERION RANGE 
    Methods include but not limited to arrest, written notice and summons.
     

    ASSESSMENT CRITERION 3 
    Sections of the Criminal Procedure Act referring to the recording of bodily prints are explained as they apply to road traffic law enforcement.

    Explain the role and importance of the Law of Evidence within the justice system.

    ASSESSMENT CRITERION 1 
    The concept of Law of Evidence is defined within the South African justice system. 

    ASSESSMENT CRITERION 2 
    The principles of Law of Evidence are explained in terms of their applicability in a road traffic law enforcement environment. 
    ASSESSMENT CRITERION RANGE 
    Principles refer to but are not limited to proof, prima facie, burden of proof, cautionary rule, presumptions, techniques acceptable to refresh one's memory, beyond a reasonable doubt, conclusive proof and facts in dispute.
     

    ASSESSMENT CRITERION 3 
    Different types of evidence are explained in terms of Law of Evidence. 
    ASSESSMENT CRITERION RANGE 
    Types of evidence refer to but are not limited to hearsay evidence, real evidence, similar facts and character of persons.

    Concepts of Law of Evidence are explained in terms of their applicability in a policing environment.

    Concepts include but are not limited to confessions, admissions, pointing out (identity parade), privilege, admissibility and relevance.

    An explanation is given of the elements of a crime.

    A description is given of the categories of participants to the commission of crime.

  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
  • Anyone assessing a learner against this Unit Standard must be registered as an assessor with the relevant ETQA or with an ETQA that has a Memorandum of Understanding with the relevant ETQA.
