PURPOSE OF THE UNIT STANDARD 
The purpose of this standard is to ensure that learners understand and are able to apply the legislation directly pertaining to the work of a traffic officer. This legislation forms the basis of a traffic officer's training; without knowledge of this legislation traffic officer cannot perform his/her activities. This standard, together with the standard entitled 'Demonstrate an understanding of the legislative framework for traffic law enforcement' at NQF Level 4 will give the learner the necessary legal grounding in traffic law enforcement.

Learners credited with this standard will be able to:
  • Demonstrate an understanding of the purpose and the general definitions in the legislation pertaining to officers, road users and vehicles.
  • Apply the legal requirements in respect of vehicles and drivers.
  • Apply legislation and procedures regarding roadworthiness of vehicles.
  • Apply legislation pertaining to the controlling of operators as defined in the National Roads Transport Act.
  • Enforce the rules of the road.
  • Identify offences for which presumptions must be used.

    Demonstrate an understanding of the purpose and the general definitions in the legislation pertaining to traffic officers, road users and vehicles. 
    OUTCOME RANGE 
    Legislation refers to the Road Traffic Act and the National Road Traffic Act. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    An explanation is given of the purpose, scope and principles of the legislation. 

    ASSESSMENT CRITERION 2 
    An explanation is given of the importance of the definitions in terms of the role of a traffic officer. 

    ASSESSMENT CRITERION 3 
    An explanation is given of the powers and duties of a traffic officer. 

    SPECIFIC OUTCOME 2 
    Apply the legal requirements in respect of vehicles and drivers. 
    OUTCOME RANGE 
    The legal requirements refers but is not limited to registration and licensing, change of ownership of vehicles, special permits, temporary permits, motor trade numbers, vehicles exempt from registration and licensing, drivers and learners licences and instructors certificate. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    An explanation is given of the difference between vehicles that must be registered and those that must be licensed. 

    ASSESSMENT CRITERION 2 
    An explanation is given of the legislative requirements pertaining to the use of permits and trade numbers. 
    ASSESSMENT CRITERION RANGE 
    Permits include temporary and special permits.
     

    ASSESSMENT CRITERION 3 
    An explanation is given of the learners and driving licence requirements as determined by legislation. 
    ASSESSMENT CRITERION RANGE 
    The explanation should include licence categories.
     

    ASSESSMENT CRITERION 4 
    The documents and licences required from a driver or owner of a vehicle are validated so as to ensure legal compliance. 

    ASSESSMENT CRITERION 5 
    Vehicle classification is authenticated against that of the vehicle licence. 

    ASSESSMENT CRITERION 6 
    Drivers requiring professional driving permits are identified in order to ensure legal compliance. 

    ASSESSMENT CRITERION 7 
    Appropriate action is instituted where the requirements of registration and licensing are not complied with. 
    ASSESSMENT CRITERION RANGE 
    This includes but is not limited to violations of registration and licensing regulations and violation of legislation pertaining to license categories.
     

    SPECIFIC OUTCOME 3 
    Apply legislation and procedures regarding roadworthiness of vehicles. 
    OUTCOME RANGE 
    This includes but is not limited to roadworthy requirements, dimensions and loads on vehicles. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    An explanation is given of the definitions and terminology used for loads. 
    ASSESSMENT CRITERION RANGE 
    Includes but is not limited to dimensions, projections, passenger carrying vehicles, seating capacity and manufacturer's specifications.
     

    ASSESSMENT CRITERION 2 
    Un-roadworthy vehicles and the vehicles that require roadworthy certificates are identified under working conditions. 

    ASSESSMENT CRITERION 3 
    Un-roadworthy vehicles are dealt with according to standard operating procedure. 
    ASSESSMENT CRITERION RANGE 
    This includes issuing a suspension note, registering of a criminal case against the offender, issuing a fine and making allowance for the rectification of a load so that the vehicle can continue on its journey.
     

    SPECIFIC OUTCOME 4 
    Apply legislation pertaining to the controlling of operators as defined in the National Roads Transport Act.

    ASSESSMENT CRITERION 1 
    An explanation is given of the provision in the legislation that applies to operators. 

    ASSESSMENT CRITERION 2 
    A description is given of the duties of an operator. 

    ASSESSMENT CRITERION 3 
    Vehicles are identified which operator legislation applies. 

    ASSESSMENT CRITERION 4 
    Offender operators are prosecuted in terms of the law. 

    SPECIFIC OUTCOME 5 
    Enforce the rules of the road. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    An explanation is given of the meaning and rules of road traffic signs, signals and markings. 

    ASSESSMENT CRITERION 2 
    Offenders of road traffic signs, signals and markings are dealt with in terms of the law. 

    ASSESSMENT CRITERION 3 
    A description is given of the circumstances in which rules of the road can be disobeyed by a traffic officer. 

    SPECIFIC OUTCOME 6 
    Identify offences for which presumptions must be used. 
    OUTCOME RANGE 
    The presumptions are based on but not limited to the owner of vehicle, the traffic officer and public roads.

    The application of a presumption is justified within the law.

    References to presumptions are recorded on charge sheets.

  • An individual wishing to be assessed (including through RPL) against this Unit Standard may apply to an assessment agency, assessor or provider institution accredited by the relevant ETQA, or an ETQA that has a Memorandum of Understanding with the relevant ETQA.
