PURPOSE OF THE UNIT STANDARD 
Learners credited with this unit standard are able to present evidence in a court of law, having prepared themselves thoroughly beforehand, and to review strengths and weaknesses of the case and how it was handled afterwards.

    UNIT STANDARD RANGE 
    This unit standard applies to persons enforcing animal protection legislation. 

    Specific Outcomes and Assessment Criteria: 

    SPECIFIC OUTCOME 1 
    Prepare for presentation in a court of law. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Appropriate dress code and personal grooming standards are identified that are suited to presentation in a court of law. 

    ASSESSMENT CRITERION 2 
    A letter of authority to provide evidence in a court of law is obtained in accordance with organisational procedures. 

    ASSESSMENT CRITERION 3 
    The cycle of evidence is explained in terms of court proceedings. 
    ASSESSMENT CRITERION RANGE 
    Cycle of giving evidence in a court refers to evidence-in-chief, cross-examination, re-examination and questions by court.
     

    ASSESSMENT CRITERION 4 
    An outline is provided of the main features of the case and the parts of the Acts which have been contravened. 

    ASSESSMENT CRITERION 5 
    Potential questions that could be expected under cross-examination for a particular case are suggested.

    Factors are identified that contribute to a decision making processes as to whether an oath should be taken or an affirmation made.

    Evidence presented is factual and does not include opinions unless specifically asked for. 

    ASSESSMENT CRITERION 4 
    Other material that could be presented in a court of law is identified in terms of it's applicability as evidence. 

    ASSESSMENT CRITERION 5 
    The defence attorney is challenged as necessary in cases where multiple questions are asked. 

    SPECIFIC OUTCOME 3 
    Evaluate the effectiveness of a court case upon completion. 

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    All documents and physical evidence are confirmed to have been submitted according to the plan. 

    ASSESSMENT CRITERION 2 
    Copies of all documents and visual evidence are confirmed to have been provided prior to the submission. 

    ASSESSMENT CRITERION 3 
    Regular communication with the Public Prosecutor and Investigating Officer are confirmed to have been maintained. 

    ASSESSMENT CRITERION 4 
    Use of different types of evidence is confirmed to have been authorised with the Public Prosecutor as necessary. 

    ASSESSMENT CRITERION 5 
    Relevant pieces of Acts are confirmed to have been explained to the Public Prosecutor and Investigating Officer. 

    ASSESSMENT CRITERION 6 
    Additional Acts are confirmed to have been considered for a more severe sentence depending on the nature of the case. 
    ASSESSMENT CRITERION RANGE 
    Other Acts include the Meat Safety Act of 2000 and the Abattoir Hygiene Act of 1992 with their replacements.

    Organisational standards are confirmed to have been maintained when preparing for and presenting evidence.

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    A real court case, a role play or case studies with experienced facilitators/assessors may be used as a basis for assessment.
  • Assessors and moderators must be registered with the relevant accredited ETQA.
  • Assessors should be in possession of a relevant qualification that is at least one level higher than the level of this unit standard or have at least 5 years relevant practical experience.
  • Training providers must be accredited by a relevant ETQA.
  • Assessment should include both formative and summative assessment.
