PURPOSE OF THE UNIT STANDARD 
There are many Acts pertaining to animals but few of them have reference to the welfare of animals. However, some of these other Acts can be used in support of a case under animal cruelty legislation, and inspectors are expected to have inherent knowledge of these pieces. One Act is concerned with injuries to people caused by animals. Inspectors should be aware of it if only to explain to complainants that such matters are outside their jurisdiction/boundary. Inspectors should identify the contents of the Acts applicable to the context and scope of their operation. They are also expected to show competence in the understanding of Codes of Practice, with reference to a Section of the Criminal Procedures Act.

This unit standard addresses that need and learners accredited with it will be able to:

  • Explain powers of entry.
  • Explain powers of seizure and relevant legislation.
  • Describe offences covered by animal cruelty legislation.

    Roles and responsibilities of Animal Protection Inspectors are described in terms of entry to private property in an animal protection situation.

    Circumstances in which an inspector's authority can supersede that of a Police Officer are explained in accordance with relevant legislation. 

    ASSESSMENT CRITERION 3 
    Additional powers given to an inspector under certain circumstances for performing animals is explained in terms of relevant legislation.

    Explain powers of seizure and relevant legislation.

    ASSESSMENT CRITERION 1 
    The regulations of the Criminal Procedures Act covering seizure are identified and explained in terms of the impact on work performance for an inspector. 

    ASSESSMENT CRITERION 2 
    An explanation is given of the factors to be considered prior to the implementation of this regulation. 

    ASSESSMENT CRITERION 3 
    Alternative ways of obtaining the right to seize animals if the matter is not urgent are identified in accordance with relevant legislation. 

    ASSESSMENT CRITERION 4 
    The processes of carrying out emergencies and euthanasia are described in terms of minimising suffering to animals and without destroying evidence. 

    ASSESSMENT CRITERION 5 
    The advantages of getting the 'owner' to sign the animals over to the organisation are explained in terms of the process for dealing with the animal and minimising suffering without outside interference.

    Cruel behaviour when liberating birds is described in terms of actions and conditions. 

    ASSESSMENT CRITERION 5 
    The laying, clearing and selling of traps is described in terms of the methods employed and the effect on different animals.

    Circumstances are described in which killing specific animals is an offence. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Assessment of this unit standard should be contextual and practical.
  • Assessors and moderators must be registered with the relevant accredited ETQA.
  • Assessors should be in possession of a relevant qualification that is at least one level higher than the level of this unit standard or have at least 5 years relevant practical experience.
  • Training providers must be accredited by a relevant ETQA.
  • Assessment should include both formative and summative assessment.
