PURPOSE OF THE UNIT STANDARD 
The person credited with this Unit Standard will be able to apply a knowledge and understanding of the legal principles of international trade and transportation to forwarding operations.

The qualifying learner is capable of:
  • Explaining areas of legal exposure in a freight forwarding environment.
  • Managing legal exposure of freight forwarding organisation.
  • Advising importers and exporters of the legal implications of international trade.

    ASSESSMENT CRITERION 1 
    The law which governs the relationship between the agent and his principal is explained in the context of freight forwarding. 

    ASSESSMENT CRITERION 2 
    The effect of the conditions of carriage of airlines, shipping lines, surface carrier companies are explained for freight forwarding, importing and exporting operations. 

    ASSESSMENT CRITERION 3 
    The legal responsibilities of the freight forwarder are explained in terms of the international commercial terms (Incoterms). 

    ASSESSMENT CRITERION 4 
    The legal implications of South African legislation are described in terms of freight forwarding operations. 
    ASSESSMENT CRITERION RANGE 
    South African legislation may include but is not limited to Customs and Excise Act, VAT Act, National Road Traffic Act, Carriage of Goods by Sea Act, Carriage of Goods by Air Act, Transnet Act, Financial and Intermediary Services Act and South African Bureau of Standards Act.
     

    ASSESSMENT CRITERION 5 
    Implications of international regulations and bodies are described in terms of freight forwarding organisations. 
    ASSESSMENT CRITERION RANGE 
    International legislation may include but is not limited to Convention on International Trade on Endangered Species (CITES), International Maritime Dangerous Goods Code (IMDG), International Regulations for Fumigation and Disposal of Packaging Material, International Air Transport Association (IATA), Dangerous Goods Regulations, Warsaw Convention, Hague Rules, Hague Visby Rules, Hamburg Rules, International Standards Organisation (ISO), International Maritime Organisation (IMO), World Trade Organisation (WTO).

    The local freight forwarders standard trading conditions are compared with those recommended by an international association of freight forwarders.

    The legal exposure of the freight forwarding organisation is analysed on terms of its operational functions. 

    ASSESSMENT CRITERION 2 
    Recommendations are made for standard trading conditions which are aligned to liabilities inherent the organisation's operational functions. 

    ASSESSMENT CRITERION 3 
    Policies and procedures are implemented in order to minimise the organisation's exposure to legal action. 

    ASSESSMENT CRITERION 4 
    The consequences of failing to manage exposure to legal action are explained with practical examples. 

    SPECIFIC OUTCOME 3 
    Advise importers and exporters of the legal implications of international trade.

    Importing/exporting activities of the client are analysed in order to assess legal exposure. 

    ASSESSMENT CRITERION 2 
    Recommendations are made to importers and exporters regarding minimisation of legal exposure.

    Legal advice is given to importers and exporters regarding action to be taken under specific circumstances. 
    ASSESSMENT CRITERION RANGE 
    Specific circumstances may include but is not limited to third party claims, claims against third parties, customs rulings and penalties and contracts of purchase and sale.
