PURPOSE OF THE UNIT STANDARD 
This Unit Standard is designed to assist learners in understanding the meaning of and engaging in ethical behaviour according to the principles for the practice of non-discrimination. It further assists in assuring high standards of ethical conduct for the sector, workplace or institution, and helps individuals to regulate their own moral conduct based on the principles of non-discrimination. It is also aimed at guiding learners to determine for themselves which actions or forms of behaviour are within the limits of their authority, confidence and trust.

People credited with this unit standard are able to:
  • Explain non-discrimination.
  • Identify and explain ethical principles underpinning the practice of non-discrimination.
  • Describe best practices for non-discrimination.
  • Analyse the consequences of discrimination and non-discrimination. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already competent in terms of the following outcomes or areas of learning when starting to learn towards this unit standard:
  • Communications at NQF Level 4 or equivalent competence.
  • It is recommended that learners should complete the Unit Standard, Demonstrate an understanding of the ethical foundations of society before attempting this Unit Standard. 

  • UNIT STANDARD RANGE 
    The typical scope of this Unit Standard is:

    1. Non-discrimination relating to: race, gender, religion, ethnic or social origin, colour, age, culture and language.
    2. In situations, such as marital status, pregnancy, family responsibility, disability, HIV status, conscience, political opinion, birth.

    SPECIFIC OUTCOME 1 
    Demonstrate an understanding of non-discrimination. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Non-discrimination is defined in relation to different kinds of discrimination and the practical and moral needs for non-discrimination. 
    ASSESSMENT CRITERION RANGE 
  • Practical needs include: discrimination of the basis of race and gender, historical discrimination, age, disability, appearance, ethnicity, economic discrimination, class discrimination).
  • Moral needs include: inclusivity, rights, fairness, justice, respect for persons, common good.
     

  • ASSESSMENT CRITERION 2 
    Discrimination is described and explained in relation to different historical, psychological, political, emotional, social, and familial contexts. The ideas that have informed non-discrimination and discrimination are identified and explained in relation to the past and current South African society. 

    ASSESSMENT CRITERION 3 
    The ideas of discrimination and non-discrimination are clarified in terms of key ethical concepts and approaches accepted in current literature on non-discrimination. 

    ASSESSMENT CRITERION 4 
    Various approaches to the theory and practice of non-discrimination are identified and explained in terms of their underpinning ethical foundations. 
    ASSESSMENT CRITERION RANGE 
    Ethical foundations include: virtue ethics, respect for person ethics, common good, self examination (Plato), consequentialist ethics - practical consequences of not being tolerant (utilitarianism); human dignity.
     

    ASSESSMENT CRITERION 5 
    Approaches to the theory and practice of non-discrimination are explained in terms of their components, internal logic, and strengths and weaknesses. 

    SPECIFIC OUTCOME 2 
    Identify and describe factors that promote non-discrimination. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Factors and/or mechanisms in society that cause us to discriminate are identified and suggestions for ways of overcoming discrimination are realistic key ethical concepts. 
    ASSESSMENT CRITERION RANGE 
    Factors include: ignorance; value attached to certain things like status; selfish ambition; upbringing; culture; stereo-types; prejudices; religion; ideologies; class; hidden agendas (hegemony); power; history; individual and social preferences.
     

    ASSESSMENT CRITERION 2 
    Mechanisms through which discrimination is hidden, or taken out of public consciousness, are identified. Proposed solutions are realistic and contribute to raising awareness of discriminatory practices. 

    ASSESSMENT CRITERION 3 
    Examples of 'institutionalised' discrimination are identified and described in terms of causes, consequences and individual and social responsibility to vulnerable groups. 
    ASSESSMENT CRITERION RANGE 
  • 'Institutionalised' discrimination includes: pollution by large corporates; environmental racism (corporate use of 'cheap' land - next to poor/'black' areas - for factories or dumps); social determinants of health: access to basic commodities (water/sanitation and food security, including pricing policies, regulation and recourse); problems created 'upstream' for 'downstream' people.
  • Vulnerable groups include: women and children; communities currently deprived of infrastructure
     

  • ASSESSMENT CRITERION 4 
    Social practices and organisational forms that foster non-discrimination are identified and described in terms of underpinning ethical principles and impact in the particular context. 
    ASSESSMENT CRITERION RANGE 
    Practices and forms include: RPL, developmental based assessment, equality of opportunity, consultative and participatory approaches, transparent implementation of policies and procedures, demographic representation, education - skills development, access to learning; opportunities/freedom to question and challenge (voice).
     

    ASSESSMENT CRITERION 5 
    Legal instruments and regulatory guidelines for non-discrimination are analysed in relation to their underlying ethical concepts, and their impact in relation to their intended purpose. 
    ASSESSMENT CRITERION RANGE 
    Instruments and guidelines include: 'Promotion of equality and prevention of unfair discrimination Act 4/2000'; the Constitution; the UDHR; New International Criminal Court.
     

    SPECIFIC OUTCOME 3 
    Identify and explain ethical principles underpinning the practice of non-discrimination in South Africa.

    The ethical principles are identified and explained in terms of their key elements. 

    ASSESSMENT CRITERION 2 
    The principles are described in their relation to the Constitution of South Africa. 

    ASSESSMENT CRITERION 3 
    The ethical principles underpinning the understanding of non-discrimination are explained in relation to instances of discrimination/non-discrimination in the workplace/sector/institution. 

    ASSESSMENT CRITERION 4 
    The practices of non-discrimination from various sources within South Africa are analysed in terms of their impact on human lives as lived. 

    ASSESSMENT CRITERION 5 
    The consequences of discrimination are analysed in relation to South Africa's history and the impact on particular professions, sectors and institutions. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    Assessment of this Unit Standard should be contextual, practical and be conducted in the workplace as far as possible.
  • Assessors must be registered as assessors with the appropriate ETQA.
  • Moderators must be registered as assessors with the appropriate ETQA, or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
  • The mechanisms and requirements for moderation should be applied as per the SAQA criteria.
  • Assessment should include both formative and summative assessment.
  • Training providers must be accredited by the appropriate ETQA or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
