PURPOSE OF THE UNIT STANDARD

This unit standard is intended for all managers who should know the requirements of the OHSA and the consequences of non-compliance rather than the finer details of the Act. The focus is on the application of the Act for compliance.

The qualifying learner is capable of:

Understanding the basic principles of the Act and accompanying Regulations.

Explaining the requirements for minimum compliance stipulated in the Act.

Interpreting the management controls required to achieve compliance.

Understanding the record keeping required by the Act.

Explaining the obligations of managers in terms of communication and training.

There is open access to this unit standard. Learners should be competent in Communication and Mathematical and Financial Literacy at NQF Level 3.

Demonstrate knowledge and understanding of the basic principles of the Act and Regulations.

1. The concept of civil liability is explained with examples.

ASSESSMENT CRITERION 2

2. The concept of criminal liability is explained with examples.

ASSESSMENT CRITERION 3

3. Reasons for the existence of the Act are explained with reference to good corporate governance.

ASSESSMENT CRITERION 4

4. The generic structure of the Act is known and the Act and Regulations are used to access information on three different aspects.

5. The responsibility of an organisation to ensure compliance within the generic framework of the Act is explained relative to the duties of employer, employees and contractors.

6. The accountability of the Chief Executive Officer or person deemed to be the Chief Executive Officer under the Act is explained and an indication is given of the legal implications of non-compliance.

3. The obligation of the employer to provide the means to comply with the Act are explained with reference to resources and financing.

1. The aspects of the Act and Regulations applicable to a specific business are identified and interpreted into a compliance plan for the organisation.

2. A risk assessment in relation to the plan is conducted and an indication is given of control measures required to contain the assessed risks at an acceptable level.

3. A case study is used to assess and review risk control measures in an organisation.

Demonstrate knowledge and understanding of record keeping required by the Act and Regulations.

1. Documents that have legal status are named and an indication is given of why each is necessary and the timeframes relating to each of the documents.

2. The use of documents and records in a management audit to prove legal defense, compliance, and corporate governance is explained with reference to the evidence each document provides.

Explain the obligations of managers in terms of communication and training.

ASSESSMENT CRITERION 1

1. The training required to ensure that employees are conversant with the hazards and precautions necessary to ensure health and safety in the workplace are explained with reference to risk exposure, precautions required for safe work, equipment for safe work procedures, duty to report and monitoring of the quality of the safety programme.

2. The legal requirements in respect of training are explained for a specific workplace.

ASSESSMENT CRITERION 3

3. The duties of employees to comply with safety requirements and report health and safety risks or threats to themselves are explained and a process is proposed to ensure compliance.

UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS

Accreditation for this Unit Standard shall be obtained from the relevant Education and Training Quality Assurance Body, through summative and formative assessment by a registered assessor.

Assessors must be registered as an Assessor with the INSQA or with an ETQA that has a Memorandum of Understanding with the INSQA.

Moderators must be registered as assessors with INSQA, or with an ETQA that has a Memorandum of Agreement with INSQA.

Training providers must be accredited by the relevant ETQA.

Moderation should include both internal and external moderation where applicable.
