PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended for elected political leaders and public sector officials involved with the service delivery activities at a top strategic level. This Unit Standard contributes to the development of management capacity to operate effectively and appropriately within a democracy governed by the rule of law. The qualifying learner will be able to apply the elements of law, convention, practice and ethics fundamental to public. It will enable the learner to read the law, understand how it works and fails, conditions of reasonable performance in operation and how to successfully navigate through the complexities of government.

The qualifying learner is capable of:
  • Identifying and explaining the main features of Cabinet and parliamentary government in the South African context.
  • Demonstrating an understanding of the relationships between legal rules, political structures, Cabinet and other administrative processes and policy outcomes.
  • Evaluating how "regulation" can, should, does and does not work to solve problems.
  • Interacting with stakeholders and entities within the public sector, particularly in using the resources of the group for developing arguments about particular issues and problems.

    The constitutional functionality of national, provincial and local government is described with examples.

    The principles of the rule of law are discussed with examples.

    The relationship between the executive and legislative functions in South Africa are critically assessed against principles of the rule of law. 

    ASSESSMENT CRITERION 4 
    The independence of the judiciary as a component of government is assessed in the context of public administration and the rule of law. 

    SPECIFIC OUTCOME 2 
    Demonstrate an understanding of the relationship between legal rules, political structures, Cabinet and other administrative processes and policy outcomes.

    ASSESSMENT CRITERION 1 
    The various categories of rules of conduct applicable to public administration are listed and explained with examples. 
    ASSESSMENT CRITERION RANGE 
    Categories include but are not limited to constitutional law, common law, administrative law, statutory law, codes of conduct and ethics.
     

    ASSESSMENT CRITERION 2 
    The legal and other conduct rules governing political structures are discussed in the context of the rule of law. 

    ASSESSMENT CRITERION 3 
    The legal rules and other conduct rules governing cabinet decisions are discussed in the context of the rule of law. 

    ASSESSMENT CRITERION 4 
    Administrative law protections for citizens against abuses by public sector authorities are discussed and critically evaluated in the context of the rule of law. 

    ASSESSMENT CRITERION 5 
    The impact of legal rules and other conduct rules on policy outcomes is critically assessed for public administration.

    Problems are analysed and solutions sought in a setting governed by public law and other rules of public administration.

    The roles of regulation promulgated under acts of parliament in the legislative process is analysed and critically evaluated against rule of law concepts. 

    ASSESSMENT CRITERION 2 
    Theories relating to democracy and law making are discussed in evaluating various regulations promulgated under legislation. 

    ASSESSMENT CRITERION 3 
    Good governance principles in drafting regulations are discussed and evaluated in the context of public administration and the rule of law. 

    ASSESSMENT CRITERION 4 
    The constitutionality of regulations is evaluated in the context of rule of law and democratic principles with a view to establishing principles applicable to making regulations. 

    SPECIFIC OUTCOME 4 
    Interact with stakeholders and entities within the public sector, particularly in using the resources of the group for developing arguments about particular issues and problems.

    The rules and protocols relating to proper behaviour and interaction with stakeholders and entities are described with examples.

    Planning and preparing for stakeholder and entity interactions are executed with a view to developing arguments.

    Planning includes but is not limited to argument definition, considering stakeholder interests and objectives.

    Stakeholders and entities are engaged in order to define arguments about public administrative issues and problems.
