PURPOSE OF THE UNIT STANDARD 
This Unit Standard is intended to provide learners with a basic understanding of environmental law as well as relevant principles, rights, duties and responsibilities. Learners achieving this Unit Standard will be able to apply knowledge of basic environmental law to their own work context. This competence will enable learners to justify the decisions and actions taken. Learners will also be able to distinguish those actions which might be unreasonable and not within the scope and context of the broad goals of environmental law. Learners will also be able to identify possible non-compliances with the environmental law in the context of their immediate work surroundings, as is required, for example, by the ISO14001 Standard.

The learner will be capable of:
  • Explaining the broad environmental principles, rights, responsibilities and duties of all South African citizens
  • Identifying and describing the roles and functions of institutions that develop and implement environmental law
  • Identifying and describing environmental legal rights, duties and remedies that are relevant to a particular society and environment interaction
  • Apply environmental legal principles and responsibilities to a society and environment interaction problem

    Broad processes by which environmental law is developed, and institutions involved in this process, are described with examples.

    Bodies or structures that administer environmental law are identified and an overview of their roles is provided with reference to different work contexts.

    The role of courts and quasi-judicial bodies in maintaining environmental law is described in relation to specific cases.

    Channels for taking up grievances in terms of environmental law are described with examples.

    ASSESSMENT CRITERIA     

    ASSESSMENT CRITERION 1 
    Environmental legal principles and rights are applied to a society and environment interaction problem in a specific community and an appropriate action plan is developed in consultation with community members.

    Responsibilities and duties of the action plan committee are assigned and explained in relation to the society and environment interaction problem.

    Assessment of this Unit Standard should be contextual and practical as far as possible.
  • Assessors must be registered as assessors with the relevant ETQA.
  • Assessors, accredited by the relevant ETQA, must have a qualification relating to Society and Environment Interactions or an equivalent qualification at NQF level 5.
  • Moderators must be registered as assessors with the appropriate ETQA, or with an ETQA that has a Memorandum of Understanding with the appropriate ETQA.
  • Moderation should include both internal and external moderation where applicable.
  • Training providers must be accredited by the relevant ETQA.
